Upton Planning Board will hold a hearing next week regarding proposed changes to the Upton Zoning Laws which will add a temporary moratorium on medical marijuana treatment centers.
On Wed March 13, 2013 Martha Coakley ruled towns could not block medical marijuana dispensaries from opening up shops within their borders, although towns would be permitted to adopt zoning rules that limit where dispensaries can set up shop. Coakley stated that the legalization of medical marijuana is enshrined in state law and “cannot be served if a municipality were to prohibit treatment centers within its border, for if one municipality were allowed to do so, all could do so, making reasonable access impossible.”
“We want to put some thought in to it and do it right,” said Upton Town Manager Blythe Robinson. The temporary moratorium will give the town the time it needs to develop a plan as to where this types of facility should be zoned.
The public hearing will be held on Tuesday, June 11, 2013, 7:15 p.m. at Nipmuc Regional High School, Professional Development Center (PDC). A complete text relative to the proposed amendment is available for inspection during regular business hours at the Town Clerk’s office. Any person interested or wishing to be heard on the zoning proposal should attend the hearing.
