On January 27 the Surface and Transportation Board (STB) determined the Board has authority to issue a declaratory order to eliminate a controversy or remove uncertainty regarding a planned propane facility in Grafton. The STB stated a controversy exists as to whether G&U Railroad would be the financier, owner, and operator of the proposed transload facility and whether the Town’s enforcement of state and local permitting and preclearance statutes and regulations in connection with the facility is preempted.
Today the G &U Railroad submitted additional information and arguments outlining their financial health and how they plan to complete and operate the proposed propane facility in North Grafton.
