Grafton and Upton Railroad Co. file request for final ruling

Greater Grafton is reporting the Grafton and Upton Railroad is looking for the court to make a quick decision regarding the town of Grafton’s case against them. G&U Railroad is currently under a temporary restraining order which stops them from receiving delivery of four 80,000 gallons tanks which they plan on storing propane gas in at a location in North Grafton. 

The railroad has had several business inquiries which they can’t follow through on. If the court were to find in favor of the Grafton and Upton Railroad the railroad will seek an unspecified amount from the town to cover costs and damages. 

The question is pre-emption.
