On Wed March 13, 2013 Martha Coakley ruled towns could not block medical marijuana dispensaries from opening up shops within their borders, although towns would be permitted to adopt zoning rules that limit where dispensaries can set up shop. Coakley stated that the legalization of medical marijuana is enshrined in state law and “cannot be served if a municipality were to prohibit treatment centers within its border, for if one municipality were allowed to do so, all could do so, making reasonable access impossible.”

As a followup comment to below… I would certainly not want them in residential areas. Seems to me that they should be in commercial/industrial areas only.
Do we know if there are state zoning restrictions as to where these can go? It seems that many Massachusetts communities are proactively passing bylaws to determine where in the community these can go. Just wondering if we don’t pass any local bylaws, can they be located anywhere in the town?
