Upton Police Investigate Broken Window Caused by Excavator Clearing Brush on Railroad Tracks

uptonpoliceOn the morning of Friday January 19, 2014 the Upton Police Department responded to a Dairy Drive home for a broken window. After investigating the incident the Upton Police determined a rock had been propelled from a large excavator which was being used to clear brush on the railroad tracks which run behind the neighborhood. The excavator was approximately 300 feet away from the Dairy Drive home when a baseball size rock shattered the home’s window. No one was injured.

The Upton Police Department spoke with the Operations Manager of the Grafton Upton Railroad about the incident. According the police report the Operations Manager indicated the excavator has safety guards to prevent debris from flying but it would be possible for debris to escape the safety guards. The item would need to enter the excavator just the right way.

According to the Upton Police Report, Grafton Upton RR owner John Delli Priscoli stated that they took full responsibility for the incident and would take care of all damages incurred. In a statement to Upton Daily Doug Pizzi, spokesperson for the Grafton Upton Railroad, wrote “A Grafton and Upton Railroad crew was clearing brush in that area at the time of the incident and the railroad is investigating the matter.”

Upton Police Chief Bradley advised the  police report regarding the incident has been submitted to OSHA and will be sent to the Federal Railroad Administration for their review.  Chief Bradley said, “Obviously this case is very concerning, fortunately no one was injured.”
