The Upton Police Department and the Worcester District Attorney will not pursue charges of assault against Mendon Upton Superintendent Dr. Maruszczak and Upton Selectman Flemming. The Worcester District Attorney’s office wrote in a Memorandum that witness statements reviewed, including the statement provided by Mike Watson, reveal no viable basis for criminal charges.
Watson had reported to the Upton Police he was assaulted at a multi board meeting claiming Maruszczak threw a paper folder at him and called him a jerk and other names. Watson also claims Flemming verbally assaulted him. In a statement to police Watson said he feared he might be struck or attacked at the meeting.
Upton Police interviewed fifteen (15) individuals who were named by Watson as witnesses.
None of the witness statements back up Watson’s allegation that the argument had reached a level that any person should be fearful of being struck. Witnesses report that the rigid folder Watson claims was intentionally thrown at him was a paper folder which was tossed, slid, or flipped across the table in his direction and that the folder landed on the table. Witnesses also report Maruszczak remained seated during the majority, if not all, of the argument and that there was a table between Watson and Maruszczak.
According to witnesses Maruszczak and Watson called each other jerks and bickered over respect.
Flemming wrote in his statement to Upton Police that he told Watson, “I’ve heard about you and now I know that you are a nutbag.” Several witnesses heard Flemming call Watson a “nutbag”.
According to the police report, Mendon Finance Committee member Will Angenent said that Mr. Watson did not appear to be fearful. The report also states that Angenent said “We are more afraid of him (Watson) than he is of us” and that he (Angenent) had previously expressed concern to a member of the Mendon Police Department about safety during a recent Mendon Finance Committee Watson attended.
The Upton Police Department decided it was necessary to bring in the Worcester District Attorney’s office due to several emails directed to Upton Police Chief Bradley from Watson claiming he would not be treated fairly by the department during the days following his initial report. Upton Police quote Watson as saying, “I cannot expect an impartial investigation….If they (Upton Police) fail to bring formal charges due to their conflict with the BOS and SRO connection and funding) I will bring the issue to the DA.” Watson told the police he believed the department would simply go through the motions of an investigation without any intention of taking action against Maruszczak or Flemming.
Some reports on social media stated the reason Upton Police sent this matter over to the District Attorney’s office was because the allegations were against public officials. According to the police report the reason was because of Watson’s multiple emails and not who the allegations were against.
According to the report Watson later indicated to the police he did not wish to pursue criminal charges against Maruszczak.

Upton Daily (UD) decided not to share a link to all 15 witness statements because UD believes people deserve some level of privacy. No one is talking or has chatted about Mike Watson in the Mendon Upton Moms and Dads Too Facebook Group since his removal several months ago for not following the rules. Let’s not let the bully take over the wonderful things the district is doing. The more we reply the louder he speaks. Let’s celebrate all the wonderful things going on in the district. Tonight a new set of scholars are getting inducted into National Honor Society, this weekend students are being recognized for their leadership on Student Council, and next week approximately 200 students are off to the state finals for DECA. This is just a few of the great things going on at Nipmuc. I can’t speak for the other schools since both my kids are there, but I am sure others can post of great accomplishments happening in the rest of our schools. All of this is because we have wonderful administrators and teachers in place. Ignore the bully and celebrate our accomplishments!
I have always said time and again we have an excellent school community and excellent teachers. We also have wonderful students. My problem is with the administration only and their financial and operational management of the district. Period.
I’m just glad that only mr Watson’s fragile ego was hurt and that he didn’t suffer a more debilitating injury in this confrontation. I hope his ego will be able to recover.
Again, if the towns would broadcast these meetings issues of this type would not become a circus. They would be recorded as a legal record of what did and did NOT take place.

While I can appreciate the sentiments, I think I’ll continue to defend myself against Jen’s use of her blog and Mendon-Upton Moms and Dads too to slander and defame me in front of my community for doing nothing more than exercising my rights to speak out against my local officials who are raising out taxes, using deception to obtain tax dollars, who at times place our kids in harms way and who very often set bad policy. If doing so makes me a jerk and a nut bag in the eyes of some well then I wear those names as a badge of honor. Now I fully realize that I live among a mix of tax and spend liberals and some Republicans who share that view and conservative folks who value conservative ideals and low taxes. I get it and I get the name calling but get this…I will call these folks out at every opportunity until the day six people carry me away….
You are welcome to speak your mind and try to improve the schools…no one is ever stopping you from doing that. But realize that maybe if you went about it the right way and had some professionalism, people would actually take you seriously. Instead, you make ridiculous accusations just to get yourself attention. If your true priority is transparency in the school spending and improving the schools in general, have some self respect and go about it the right way. Then you might actually have people supporting you and rallying around your cause. Not many people are arguing against your actual cause (in general of supporting the schools, not your ridiculous assault accusations)), you just handle each situation in such a poor manner that no one would ever join you…even if they think you have a valid point about the budget. You can’t constantly degrade people and push buttons to get under the superintendents skin and then get offended when someone calls you a jerk. Your approach is just so ridiculous, you will never be heard or taken seriously if you continue with these tactics. Everyone can see right through you, grow up and handle the situation like an adult and maybe people will listen to the issues you bring up instead of laughing at you for your ridiculous antics.

Again, I understand folks like you don’t support me or my approach. An approach by the way that is dictated by the District and some town officials. But I can assure you I get email, calls and even letters every week from supporters. There’s always going to be two caps, and I’m happy in the one I’m in. Thanks for the advice though…
And I always seem to win and be right about the District….Odd. iPads, school safety, snow on roofs, patriotic songs, private email accounted, budget issues, public records etc. How do ya explain that?
But unfortunately no one actually wants to be associated with you, as your facebook page is evident. I see no comments or discussions on there…just a bully who tries to humiliate someone he clearly has a personal vendetta against. I’m sure you get tons of fan mail, you’re just such a stand up guy. Why don’t you actually run for a position in the town or school committee…oh wait, you’re smart enough to know no one would actually vote for you. It’s easier to be a self appointed representative of the community instead of someone who actually has a position. You might harass the superintendent and other officials enough that they concede to get you to shutup but thinking you’ve “won” is a different story. Nobody takes you seriously, especially after these most recent antics.

Mike, the only case you are making here is that you are, in fact, a jerk and a nutbag. Nobody cares that someone slid, tossed, threw, or chucked a paper folder at you because you were being rude and disrespectful. Nobody cares that someone called you a jerk, with your actions through facebook the last several days and weeks, it’s apparent that’s not the worst name you’ve ever been called. You have completely blown this out of proportion which is clearly evident, that’s all anyone gets from any story about this. Get over it and maybe you’ll have a little self respect at the end of the day.
I’ll make this quick and easy Jen so you can understand it. First, the night I reported this I stated I only wanted a report file in the event it ever happened again. The officer stated to me that because an elected official was involved, his dept. Would likely investigate the incident. They initiated the invest NOT me. Once I knew they were doing so I also knew 100% that they would cover up any wrongdoing given the players and they did just that with help from the ADA. If you thing they’re impartial or didn’t tell the DA to squash this just read her two sentence again. At the time Kevin Rudden getting choked out in the Miscoe Hill Middle School parking lot by the husband of a school committee member he disparaged was fresh in my mind. These things need to be documented. I never asked for formal charges in an email.
You missed Upton Selectman Ken Picsrd state “The School Superintendent THREW the folder in the direction Mr. Watson?” He was right next to us so he had an excellent view. Why did you leave that out of your story?
How about Jay Byer the District Business manager? Miss his too? “He flipped the folder IN THE AIR” and “there were raised voices yelling.” Does that sound like he handed it to me, placed it or slid it to me? Or does it sound like he threw it at me. Keep in mind I never said he hit me.
How about the Superintendent himself…miss his as well? “In a raised voice, I responded your not the respectful one. I believe I repeated this statement.” He never claims I was disrespectful and besides neglecting that he called a parent a jerk several times, pointed his finger in my face yelling and spitting telling me to get out and made other derogatory remarks, he told the truth to his credit. I never once yelled.
Those who downplayed the throwing, pointing and yelling were clearly trying to protect him because they hate me.

Jen, look up the elements of assault will ya! Assault has nothing to do with being hit or struck! Public officials who hold power over me and my family berating me at a public meeting, pointing at me while yelling and spitting is an assault kid. They don’t have to threaten me with words.
I’m too tired to correct any more but I will give you some advice. Having so much hate in your heart will make you an angry, bitter and lonely old maid…time to let it go.
